Welcome to Cawper & Company. These Terms and Conditions apply to your use of our website and to purchases made through Cawper & Company.

By using this website, placing an order, or submitting a custom project request, you agree to these Terms and Conditions and to the policies referenced here.

  1. PRODUCTS AND AVAILABILITY

Cawper & Company offers Original Apparel, custom embroidery, business and team branding, pet-related designs, and other embroidered or decorated goods.

Many Original Apparel pieces are one-of-one. An item placed in a shopping cart is not guaranteed until the order has been successfully completed and payment has been accepted.

Because one-of-one items cannot necessarily be replaced with an identical item, availability is limited to the quantity shown on the product page.

  1. REPURPOSED GARMENTS

Many Cawper & Company Original Apparel pieces begin with carefully selected repurposed garments.

Minor characteristics consistent with a garment’s previous life may be present and are part of the individual character of the piece. Material condition issues identified by Cawper & Company will be disclosed in the product description or photographs whenever reasonably possible.

A disclosed characteristic of a repurposed garment is not considered a defect.

  1. PRODUCT DESCRIPTIONS, COLOR AND SIZING

We make reasonable efforts to describe and photograph each item accurately.

Because screens, lighting, fabric, thread, garment construction and repurposed materials can vary, actual colors and appearance may differ slightly from photographs displayed online.

Customers are responsible for reviewing the product description, photographs, measurements and stated garment size before purchasing.

Brand sizing can vary. A size printed on a garment label does not guarantee that it will fit the same as another brand or garment in the same labeled size.

  1. CUSTOM, PERSONALIZED AND MADE-TO-ORDER WORK

Custom embroidery, personalization and made-to-order work may require customer approval of wording, spelling, colors, placement, artwork or other project details before production begins.

Once the customer approves the artwork or design and production begins, the order becomes final sale except where Cawper & Company made an error or the item is damaged or defective.

The customer is responsible for reviewing all approved spelling, wording, names, dates, colors, placement and other supplied or approved details before production.

Changes requested after approval or after production begins may require additional charges and may not always be possible.

  1. ARTWORK AND DIGITIZING

Embroidery artwork may require digitizing or other preparation before it can be stitched.

Digitizing, artwork preparation or design fees may be charged separately and may become non-refundable once that work has been completed, even if the customer later cancels the project.

Approval of an embroidery proof or design represents approval of the overall artwork, wording, placement and other details shown in that proof.

Minor differences may occur between an on-screen proof and finished embroidery because thread and fabric are physical materials.

  1. CUSTOMER-SUPPLIED ARTWORK, LOGOS AND CONTENT

When a customer supplies a logo, design, image, wording or other material for reproduction, the customer represents that they have the right or permission to use that material.

Cawper & Company may decline a project when we reasonably believe the requested material may violate another party’s intellectual property rights or is otherwise inappropriate for us to reproduce.

Customers remain responsible for obtaining any permissions, licenses or approvals needed for customer-supplied artwork.

  1. PRICES AND PAYMENT

Prices are shown in U.S. dollars unless otherwise stated.

Applicable taxes, shipping charges and other order-specific charges will be displayed during checkout when applicable.

Cawper & Company may correct pricing or listing errors. If an error affects an order that has already been placed, we will contact the customer before proceeding when reasonably necessary.

Payment must be successfully authorized before an online retail order is processed.

Custom projects may require payment, a deposit, digitizing fees or other charges before production begins.

  1. ORDER ACCEPTANCE AND CANCELLATION

An order confirmation does not necessarily mean that an order has been accepted for production or shipment.

Cawper & Company may cancel or decline an order when an item is unavailable, payment cannot be completed, there is a material listing or pricing error, or the order cannot reasonably be fulfilled.

If we cancel an order after receiving payment and no non-refundable custom work has been completed, the applicable payment will be refunded.

Custom orders may generally be cancelled before production begins, but completed digitizing, artwork preparation or other design work may remain non-refundable.

  1. SHIPPING

Shipping estimates are estimates and are not guaranteed delivery dates.

Once an order has been transferred to the shipping carrier, delays caused by the carrier, weather, incorrect addresses or other circumstances outside Cawper & Company’s reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate shipping address.

If an order is returned because an incorrect or incomplete address was provided, additional shipping charges may apply before the order is resent.

  1. RETURNS, REFUNDS AND EXCHANGES

Returns and refunds are governed by our Refund and Returns Policy.

Eligible non-custom items may be subject to the return window, condition requirements, return authorization process and shipping provisions stated in that policy.

Custom, personalized and made-to-order items are generally final sale once approved and production has begun, except when Cawper & Company made an error or an item arrives damaged or defective.

Customers must receive return approval and instructions before sending an item back.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, Cawper & Company owns or has permission to use the original website content, branding, photographs, written material and original Cawper & Company artwork displayed on this website.

Cawper & Company content may not be copied, reproduced, sold, distributed or used commercially without permission, except as permitted by law.

Customer-owned logos and customer-supplied artwork remain the property of their respective owners.

Product-specific remedies for damaged, defective or incorrect items are addressed in our Refund and Returns Policy.

The version posted on this website at the time of an order will apply to that order unless applicable law requires otherwise.
